An expert in the field of labor and employment emphasized that this activity, according to the Labor Code of the Russian Federation, is illegal, since the current labor legislation does not provide participants in labor relations with the opportunity to conclude employment contracts for remote work, which will be carried out from abroad.
“There is a traditional rationale that labor legislation is valid only within the Russian Federation, within the borders of the Russian Federation,” Pankratov said.
He drew attention to another remarkable aspect.
“After the amendments were made to the Constitution of the Russian Federation, the priority of international law over Russian legislation ceased. And if earlier in such a situation we could look for conventions of the International Labor Organization or some agreements on this topic in force in the post-Soviet space, now it is almost impossible “, the expert explained.
Pankratov believes that in this way it is impossible to turn emigration flows back to the Russian Federation.
